Throughout these Terms, “we,” “us” and “our” refer to Ultimate Creations NY. By accessing the website, purchasing a product or service, creating an account, submitting an inquiry or otherwise using the website, you agree to these Terms of Service and the policies linked from the website.
You must be legally capable of entering into a binding agreement in your jurisdiction or use the website with the permission of a parent or guardian. You may not use the website, products or services for an unlawful or unauthorized purpose or transmit malicious code.
Flowers, balloons, plants, containers, food, gifts and décor are subject to season, inventory and supplier availability. Product photographs represent the intended style, but natural materials and screen displays vary. We may make substitutions of equal or greater value while preserving the overall style and color direction, consistent with the product description and our policies.
Prices, product details and availability may change without notice. Taxes, delivery, setup, customization and service charges may apply. Fresh flowers, inflated balloons, personalized items and date-specific custom products are perishable or time-sensitive and are generally final sale. Review rights and procedures are stated in our Refund & Returns Policy.
Recurring memberships and products are governed by the price, billing frequency and benefit terms displayed at checkout and by our Subscription & Membership Policy. By subscribing, you authorize recurring billing until cancellation.
An inquiry, estimate, proposal or website submission does not reserve an event date. Event décor, installations, custom production, venue work and other project services may require a separate agreement, approved scope, retainer and payment schedule. When a separate signed agreement conflicts with these general Terms, the signed agreement controls for that project.
You agree to provide accurate, complete and current order, contact, billing, recipient, delivery and account information. You are responsible for delays, redelivery costs or failed service caused by inaccurate or incomplete information you provide.
You are responsible for maintaining the confidentiality of account credentials and for activity under your account. Notify us promptly if you believe an account or payment method has been used without authorization.
The website, branding, product photography, written content, graphics and original designs are owned by or licensed to Ultimate Creations NY and may not be copied, reproduced, sold, scraped or commercially exploited without written permission, except as permitted by law.
You may not use the website to violate law, infringe rights, submit false or misleading information, harass others, distribute malicious code, collect personal information without authorization, interfere with security, scrape the website in a manner that harms the service, or attempt to circumvent purchasing or access restrictions.
The store is hosted by Shopify and may use third-party payment, delivery, subscription, analytics, messaging and marketing services. Third-party services and websites are governed by their own terms and privacy practices. We are not responsible for third-party content or services outside our control.
We may correct errors, update content, change products, suspend features or discontinue services. Historical or general information on the website should not be treated as a guarantee of current availability.
